Position Overview

The Office of General Counsel is seeking to hire a dynamic, collaborative, detail-oriented licensed attorney in Illinois to serve as an Assistant General Counsel for the Division of Developmental Disabilities.  The Assistant General Counsel will report to the Deputy General Counsel for the Division of Developmental Disabilities. The Assistant General Counsel serves as legal advisor to the Division of Developmental Disabilities and advises on all legal matters concerning the provision of services to individuals with developmental disabilities.  While this position advises on any legal issues concerning provision of services to individuals with developmental disabilities, it will have concentrations in Medicaid law, mental health court proceedings, guardianship matters, and licensing and regulation of community programs for individuals with developmental disabilities. The Assistant General Counsel provides advice, assistance and consultation to leadership within the Division of Developmental Disabilities and to executive staff within the Department of Human Services. The Assistant General Counsel regularly liaises with attorneys from the Office of the Governor, non-profit agencies serving individuals with developmental disabilities, private attorneys, and attorneys from other federal, State, and municipal agencies.

Essential Functions

  • As an Assistant General Counsel, provides legal advice and counsel to the Department of Human Services programs operated by the Division of Developmental Disabilities, including State-Operated Developmental Centers, Home and Community-Based Medicaid Waiver programs, licensing of Community-Integrated Living Arrangements, and certification of Community Day Services programs.  
  • Advises staff at State-Operated Developmental Centers on guardianship procedures.   
  • Analyzes, drafts, and reviews proposed legislation, rules, Administrative Directives, Program Directives, and Medicaid Waivers for the Division of Developmental Disabilities.
  • Conducts complex legal research regarding legal issues which affect the Division of Developmental Disabilities as assigned by the Deputy General Counsel for the Division of Developmental Disabilities and/or General Counsel. 
  • Reviews subpoenas, search warrants, and other requests for information received by the Division of Developmental Disabilities.  
  • Performs other duties as assigned or required which are reasonably within the scope of the duties enumerated above.

Minimum Qualifications

  • Requires graduation from an American Bar Association accredited law school.
  • Requires three (3) years administrative experience in the practice of law.
  • Requires the possession of a license to practice law in Illinois.

Preferred Qualifications

  • Three (3) years of professional experience litigating matters or advising clients on issues related to individuals with developmental disabilities or mental illnesses, healthcare law, or guardianship and probate matters.
  • Three (3) years of professional experience as a licensed attorney drafting, reviewing, and negotiating contracts, data sharing agreements, or other legal agreements.
  • Three (3) years of professional experience as a licensed attorney responding to subpoenas, search warrants, and other requests for information.
  • Two (2) years of professional experience as a licensed attorney providing legal advice to management in a governmental, social services, healthcare, or nursing home organization.
  • Two (2) years of professional experience as a licensed attorney reviewing and advising on proposed changes to statutes, administrative regulations, or internal policies.
  • Two (2) years of professional experience as a licensed attorney providing legal advice to clients on interpretation and implementation of Home and Community-Based Medicaid Waivers and/or federal Medicaid laws.

  • Certain provisions of the revolving door restrictions contained in 5 ILCS 430/5-45 apply to this position.
