Position Overview

This position is accountable for the investigation, evaluation, and disposition of tort claims by and against the department; administration of lapsed appropriation claims; and the investigation and timely reporting of auto liability claims to Central Management Services (CMS) Auto Liability.

Essential Functions

  • Investigates, evaluates, negotiates, and settles all tort claims made by and against the department within authority.
  • Negotiates and settles or denies claims with the public, insurance companies, and attorneys and determines which claims should be referred to the Office of the Attorney General for legal action on the collection of disputed claims and which claims should be recommended as uncollectible.
  • Authorizes any compromise on asset recoveries for damage to department property which are handled by district offices within the Region I area and within authority.
  • Serves as an auto liability coordinator for the Central Management Services (CMS) Auto Liability Program for the investigation and timely reporting of vehicle crashes in the CMS Auto Liability System involving employees operating department owned vehicles in the scope of their employment.
  • Coordinates with the Bureau of Operations to recommend, ensure proper use of, and revise policies and procedures for the use of the Motorist Caused Highway Damage (MCHD) Fund for the repair of department vehicles, equipment, and appurtenances.
  • Reviews financial transactions within claims, ensures payments are properly credited and processed, and follows established protocols for the recordation and timely preparation for the deposit of those resources.
  • Investigates and evaluates lapsed appropriation claims made against the department for failure to pay financial obligations incurred during a prior fiscal year and prepares a department report which becomes a part of the Illinois Court of Claims record.
  • Reviews claims and determines proper classification and entry of data for claim cases in the Risk Management System (RMS) and ensures accuracy of file data.
  • Manages and administers a system of filing and record keeping for both active and prior fiscal claim file records and complies with department policy and the State Record Retention Act.
  • Determines which claim recoveries are referred to the Office of the Attorney General for collection or certification as uncollectible and which claims may be referred to the Office of the Illinois Comptroller for offset under the Illinois Debt Recovery Offset Portal (I-DROP) System.
  • Manages claim files and records and aids in the processing of files and records that may be stored offsite and in compliance with the State Records Act.
  • Performs other duties as assigned.

Minimum Qualifications

  • Completion of a bachelor's degree majoring in business, law, pre-law, or paralegal studies; OR Completion of two years of college PLUS two years of experience with claims administration involving property, personal injury, general liability, or workers’ compensation; or a combination thereof OR Six years of experience with claims administration involving property, personal injury, general liability, or workers’ compensation; or a combination thereof.
